This image captures the moment a former high school football star breaks down in court when his rape charge is dismissed. The dismissal occurred after the 16-year-old accuser admitted that the alleged incident never happened, concluding six years he spent in prison.

    https://www.nsvrc.org/statistics/

“One in five women in the United States experienced completed or attempted rape during their lifetime”

“Nearly a quarter (24.8%) of men in the U.S. experienced some form of contact sexual violence in their lifetime.”

“Nationwide, 81% of women and 43% of men reported experiencing some form of sexual harassment and/or assault in their lifetime.”

“One in three female victims of completed or attempted rape experienced it for the first time between the ages of 11 and 17”

    And

“The prevalence of false reporting for sexual assault crimes is low — between two percent and 10 percent.”

Sources for all this are linked in the site above.

I think it says a lot that some folks downvoted this despite it just being sourced stats of the level of sexual violence experienced by both men and women and the rarity of false reports. OP chose to post info about a case from more than 15yrs ago and didn’t even bother posting sources (probably because the age of the case would have tipped off how rare these types of situations are). Yes, these types of false reports are awful but the sheer number of incidents of rape against both men and women are staggering.

I upvoted it because it should be said, but to play devil’s advocate in regards to why people might be downvoting it: On threads about sexual assault, people discussing false accusations is generally discouraged, not because false accusations aren’t a problem in theory, but because it distracts from and to a point dismisses the discussion about the injustice of sexual assault currently being presented. This is essentially the same thing; if people truly believed that these issues should be discussed separately, then this is as much a breach of that rule as discussing false accusations on a post about a sexual assault incident is.

If as few as 2% of reported rapes are false accusations but as recently as 2018, it was estimated that only 25% of rapes were reported to police, I think the argument that stuff like this “should be said” falls apart. When looking at false reports, you’re looking at essentially a statistical anomaly when looking at the total number of incidents of rape. Yes, it can be said to happen, but focusing on false reports actively discourages both men and women from reporting acts of sexual violence. The problem of people not feeling safe to report or that they wouldn’t be believed is a problem orders of magnitude greater in size than false reports.

(not the person who you replied to) I thought your comment was well-reasoned and easy to understand. I had those feelings about it but didn’t have the words to describe it. It’s kind of like putting crime statistics under an article about a murderer who is black because you’re expecting racism. Kinda. Your breakdown was more accurate.

OP shows why here. This is because he believes false accusations are a bigger problem than actual rape, and is trying to craft the narrative that women don’t get raped as much as they claim.

      This is an incel post.

Theres credible evidence that these shitsmears hunted her down and drugged her. This is EXACTLY the type of case I point to when I be moan poor situational awareness in the “victims” case, that voluntarily showing up to a frat party is a bad, bad, idea if you are female. These are the kind of degenerates that host them, I’M CALLING OUT THE FRAT BOYS in case it wasn’t clear, and saying what I’m saying as A WARNING to women not an admonishment of victimhood.

These one in a thousand stories when the other 999 were legitimate are always used like this to help vindicate the narrative that women make it up

The problem is those thousand cases represent a fraction of the around one hundred thousand victims that will never get justice.

I think we would all agree she deserves some form of punishment but I think we would also agree we don’t want to scare off other false accusers from rescinding their lies. That makes figuring out what to do a lot less black and white.

Genuine Answer: While it may deter new instances, it comes at the cost of potentially harming the currently falsely accused by never letting them get justice because the fake accuser decides the cost is too high to come clean. The most precious thing we have is our time and freedom. What decision would you prefer if you were in the shoes of the falsely accused?

Its not ideal, but it is something that requires a little more consideration.

tbh I would want to see numbers on % of false accusations resolved through admission vs litigation to make this call. If the actual rate of admission is incredibly low already then the value would be negligible. And you have to weigh that against the deterrence value, and the value punishment provides in emotional restitution to the victims.

Or men abused by men, or men abused by women. My brother was stabbed by a coked-up ex, and was arrested…until one of the cops realized he was bleeding, and was actually the person who phoned the police for protection. They just assumed he was the abuser…when she was.

Assault is awful. Nobody should tolerate it, but the facts should outweigh the sentiment of the nation, or gender biases and stereotypes.

Every situation is unique, and should be treated as such…without bias.

Interesting that this is posted today. I wouldn’t be surprised if we see the few cases like this being posted to help the narrative that rape victims commonly use false accusations.

False rape accusations occur around the same rate as any other false crime accusation. About 5%.

Compared to the fact that 90% of rape perpetrators never see the inside of the courtroom, it’s clear the entire system is fucked in how they handle rape cases.

He was forced to take a plea deal before the case could be heard by a jury because of racism:

Faced with a possible 41-year-to-life sentence, he accepted a plea bargain that included six years in prison, five years of probation, and registering as a sex offender. Banks stated that he took the deal after his lawyer told him that he stood almost no chance at trial because he would likely be tried by an all-white jury who would only see “a big, black teenager.” According to Banks, his lawyer convinced him that by pleading no contest he would receive probation, but no jail time. With only ten minutes to decide and denied the right to counsel with his mother, Banks took the deal.

it’s shit like this that makes me raise an eyebrow at the term “rape survivor.” I don’t like that is the case; Has real “boy who cried wolf” energy.

KEEP READING BEFORE YOU POST A REBUTTAL

on one side you have someone who is forced to do something against their will for a relatively short time. (which is bad, no argument)

but on the other you have someone who can actually have their life destroyed by the mere accusation of the former.

Seems to me that if you are going to destroy someone you better make damn sure that they are the the perpetrator of such actions, because the punishment is far worse than the crime. (Though justifiably so, in this case)

Injustice is bad. Falsely imprisoning someone is bad. But also, not holding a rapist to account is bad. And the latter happens 1-2 orders of magnitude more frequently than the former.

This is the same bad-faith edge case fixation that anti-trans people spout about “trans girls in sports”, ignoring the fact that said people would almost certainly never be caught dead watching professional women’s sports teams. It’s a comparatively rare issue, in the context of the original issue being discussed.

Also, the fact that you appear to be trying to litigate how bad a person should feel about rape because it typically takes “a relatively short time” is disgusting and infuriating in equal measure, and tells me a lot about who you are as a person.

False accusations are incredibly common. Everyone is on edge because of the cornell case where it’s clear there was premeditation. THAT was disgusting. Using your gender as defense “because you were scared” is also EQUALLY disgusting. Grow up; the world isn’t sunshine and rainbows buttercup. what is TRUE isn’t always pleasant, and maturity is learning how to face that.

If you want to have justified out rage perhaps you should direct that at how the top 1% are raping us harder than any frat boy could to some naive freshman coed.

And on the other hand, there have been at least 3 scandals that broke in my local area alone about male teachers who were inappropriate with students being quietly moved to different school districts with huge settlement payments. And no justice for the victims.

We need to dismantle our rape culture for both types of victims.

Yeah I agree. I would say I hated working in high school. I was only like maybe seven or so years older than the students but looked just like the students–sigh at least I had a staff badge. I would often get the puppy dog eyes from female students and I thought don’t think what you’re thinking please.

In my time in high school there were cases of either-or, and nothing was done about it.
