It’s perfectly reasonable to say a temporary mental condition caused diminished capacity but that should not fully negate the crime. Massachusetts laws are very different from Federal laws and the majority of states, and MA laws would not give her a free pass if she were found to be affected by a temporary mental health issue. The problem is the mental health defense would normally result in confinement to a mental health facility, but if this was only an issue during/after pregnancy is she still a danger?
